These Terms & Conditions govern your use of the triumara.com website and, where applicable, the villa and hotel management services provided by Triumara in Bali, Indonesia.

    About us and acceptance

    triumara.com is operated by Triumara, a villa and hotel management company based in Bali, Indonesia. By accessing this website or engaging our services, you agree to these Terms & Conditions. If you do not agree, please do not use the website or our services.

  2. 02

    Definitions

    • Owner — the owner or authorised representative of a property who engages our services.
    • Property — the villa, hotel, or accommodation placed under our management.
    • Services — the sales, marketing, and operational management services we provide.
    • Guest — a person who books or stays at a managed Property.
    • Management Agreement — the separate signed agreement setting out the binding commercial terms for a specific Property.

    Our services

    We offer two engagement tiers:

    • Sales & Marketing (15%) — focused on brand presence, distribution, and revenue, for owners who already have an operations team in place.
    • Full Service — Sales, Marketing & Operational (20%) — a comprehensive solution where every aspect of the Property is professionally managed on the owner’s behalf.

    The precise scope, deliverables, and commission for each Property are confirmed in a separate Management Agreement.

    Engagement and the Management Agreement

    This website is informational. Any engagement of our services is governed by a signed Management Agreement specific to the Property, which prevails over these Terms in the event of any conflict regarding that engagement.

  5. 05

    Fees and commission

    Our fees are charged as a commission on applicable revenue at the rate agreed for the selected tier (15% or 20%), or as otherwise set out in the Management Agreement. Invoicing, payment terms, and the treatment of applicable taxes are specified in that agreement. All fees are exclusive of taxes unless stated otherwise.

    Owner responsibilities

    The Owner agrees to:

    • Provide accurate, complete information about the Property and keep it current;
    • Hold all required licences, permits, and registrations (including applicable accommodation and tax registrations);
    • Maintain adequate insurance for the Property;
    • Have the lawful right and authority to appoint us to manage the Property.
  7. 07

    Bookings and guests

    Where appointed, we manage reservations, guest communications, and the guest journey on the Owner’s behalf. Cancellations, refunds, and house policies follow the rules published for the Property and the applicable booking channel.

  8. 08

    Reporting and transparency

    We provide access to performance and expense reports, a monthly Profit & Loss statement, and an annual strategy review. Reporting frequency and format are confirmed in the Management Agreement.

  9. 09

    Marketing and content

    By engaging us, the Owner grants Triumara the right to market and promote the Property and to create and use photography, copy, and other content for that purpose, in line with agreed brand guidelines. Ownership of content is addressed in the Management Agreement.

  10. 10

    Confidentiality

    Each party agrees to keep confidential the non-public information of the other disclosed in connection with the Services, and to use it only for the purposes of the engagement.

  11. 11

    Intellectual property

    All content on this website — including the Triumara name, logo, text, and design — is owned by or licensed to Triumara and may not be copied or used without our prior written permission.

  12. 12

    Disclaimers

    While we work to grow occupancy, guest satisfaction, and revenue, we do not guarantee any specific level of bookings, occupancy, or income. This website is provided “as is” without warranties of any kind, and we do not warrant that it will be uninterrupted or error-free.

  13. 13

    Limitation of liability

    To the maximum extent permitted by law, Triumara shall not be liable for any indirect, incidental, or consequential loss, or loss of profit or revenue, arising from your use of this website. Liability in connection with the Services is governed by the Management Agreement.

  14. 14

    Indemnity

    The Owner agrees to indemnify Triumara against claims, losses, and expenses arising from the Owner’s breach of these Terms or the Management Agreement, or from the Owner’s failure to hold required licences, permits, or insurance.

  15. 15

    Term and termination

    The duration of any engagement, notice periods, and termination rights are set out in the Management Agreement. We may suspend or restrict access to this website at any time without notice.

  16. 16

    Force majeure

    Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, government action, or disruption to utilities or communications.

  17. 17

    Governing law and disputes

    These Terms are governed by the laws of the Republic of Indonesia. Any dispute arising from these Terms or your use of this website shall be subject to the jurisdiction of the competent courts in Bali, Indonesia, unless otherwise agreed in the Management Agreement.

  18. 18

    Changes to these terms

    We may update these Terms from time to time. Changes take effect when posted, as indicated by the “last updated” date above. Continued use of the website constitutes acceptance of the revised Terms.
